Bay Holiday Club ("BHC")

Terms & Conditions

1. These terms and conditions govern all aspects of a member's entitlement to participate in a reward scheme. Bay Travel Pty Ltd ABN 55 003 503 160 is offering Reward Currency to the staff of its corporate clientele based on membership and entitlement within the bounds of this document.

2. Membership in the BHC is governed by these terms and conditions.

3. The BHC has made all reasonable efforts to ensure the information provided herein is accurate.

4. The BHC accepts no responsibility for any inaccuracy or misconceptions.

5. These Terms and Conditions may be changed without notice and members will be advised if same should occur.

Definitions

(a) "Reward" means good/s and/or service/s provided by Bay Travel and/or other providers ("participating in this incentive.")

(b) "Points" means the number of points each member must earn by means of leisure travel purchases through Bay Travel in order to obtain a reward.

Membership

1. All staff members of Bay Travel corporate clients are automatically members. To register for extra services, individuals must complete the registration form in full.

2. It is the member's responsibility to advise BHC of any change in personal details.

3. Individual members must register separately and may only hold one membership, but may request that points accrue to a specified primary member.

Benefits

1. Members can earn reward points which may be redeemed to acquire eligible products offered by the participating companies.

2. The reward points are not redeemable for cash and are not convertible or transferable. Each reward redemption will require a minimum of 2000 points (no exceptions). The only way to redeem rewards is to have enough points accumulated. Multiples of rewards may also be redeemed if enough points are available to the member.

3. BHC and the participating companies do not accept responsibility for the quality of the Reward that may be provided to each member and do not accept any responsibility or liability of any nature whatsoever including but not limited to contract, in tort or under any other law, for any injury, damage, loss, delay, additional expense or inconvenience caused by the supply of the Reward pursuant to this Reward scheme including damage, loss, delay, additional expense or inconvenience caused by a member's acts and omissions or other events which are beyond the control of the BHC and the participating companies. The provision of a Reward is subject to, in each case, to the terms and conditions of the suppliers providing such Reward, which shall constitute the sole contract between the provider of the Reward and the member.

4. BHC and the participating companies will not be liable for refusal of any supplier to supply a Reward. BHC and the participating companies will accept a member's request for a Reward for processing once a member has completed a BHC Redemption Form and subject to the following provisions:- (a) A Reward shown in the BHC catalogue is subject to availability from a supplier. All rewards will be delivered to a member's nominated address within 28 days of confirming receipt of their completed Redemption Form. (b) If a Reward requested by a member has been discontinued, a similar item of equal value may be substituted, whenever possible. If a substitution of a member's Reward is not available, the member will be notified and requested to make another selection of a Reward; (c) For voucher Rewards, delivery can be made to a member’s work address only. The member will be advised if a Reward is unavailable.

5. Each member is solely responsible for any and all costs, charges, taxes, claims or liabilities of whatever nature and how so ever arising from or incurred in connection with obtaining or utilising a Reward.

6. The points cost of all Rewards can increase or decrease without prior notice to the members.

Calculation of Points

Each member is entitled to accumulate points on any leisure bookings made using the services of Bay Travel. Each dollar spent equals 1 reward point, excluding: GST, Taxes, Airport Fees, Levies, Foreign Exchange, and Incidentals.

Crediting of Points and Redeeming of Points

Once the travel booking has been fully paid by the member, and all travel has been completed, points are allocated / accumulated accordingly. The points are then available to be viewed via statement, which will be sent to members on a quarterly basis. Status of points may also be checked by contacting Bay Travel. (Reward points are valid for 3 years from date of allocation.)

Selection of Member's Reward

If a member cancels a redemption, a fee may be charged by the supplier of the Reward for the cancellation. The fee charged by the supplier will be converted to points and charged to the member's account. Fees charged by suppliers may be as high as the total value of the Reward.

BHC Credit Vouchers

BHC may from time-to-time issue BHC Credit Vouchers. Vouchers can only be redeemed on holiday bookings made through Bay Travel. Each voucher will specify a minimum spend which will be required in order to use the voucher. Vouchers may be used for any form of travel arrangements with the exception of air bookings on Virgin Blue. Each voucher will have a use-by date which cannot be extended. Travel must commence before the expiry of a use-by date. BHC Credit vouchers.

Bay Travel Privacy Policy

Bay Travel Pty Ltd ABN 55 003 503 160 recognises the importance of privacy issues.

This Privacy Policy briefly tells you how we manage the personal information that we collect, use and disclose and how to contact us if you have any queries. This Privacy Policy does not cover personal information collected or held by us about our employees and is to be read subject to any overriding provisions of law or contract.

Background

From 21 December 2001, we will comply with the law and the National Privacy Principles ("NPPs") (subject to the other provisions of law). The NPPs are contained in the Privacy Act 1988 (Cth) and regulate the manner in which personal information is managed.

Personal information is information or an opinion, in any form and whether true or not, about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.

There are further special provisions which apply to the collection of some personal information which is known as sensitive information. This includes health information and information about a persons' race, ethnic origin, political opinions, membership of political, professional or trade associations, religious or philosophical beliefs, sexual preferences and criminal history.

Collection of personal information by us

We are required to collect personal information under any laws pertaining to civil aviation and air travel.

The kinds of personal information we collect and store will depend on what products and services you request from us. However, it may include (amongst other things):

Personal information you give us when you request a product or service from us. This information may include your intended travel dates, place of departure, intended destination and whether you are an adult or a child;

Personal information you give us when you make a flight booking. This information may include your name, address, telephone numbers, e-mail address, credit card details; and

Communications between you and us; and

Transactional information about your use of our products and services (for example your feedback on our service).

How your personal information will be used

We collect your personal information so that we can use it for our functions and activities which include, amongst other things:

processing your flight, accommodation, car hire or other travel related booking; being aware of any special travel requirements (health or otherwise) you may have;

providing you with confirmation of your booking and advising you of any changes to your itinerary;

confirming your identity when you check in;

considering your employment application;

addressing any feedback or complaints you may have;

answering any queries you may have; and

any purposes for which it was requested and directly related purposes, and developing, improving and marketing our products and services.

If you do not provide us with your personal information, we will be unable to do one or more of the above (including being unable to accept any flight booking).

If you also subscribe to our Newsletter Service, we may e-mail to you updates about our products and services. If you do not wish to remain a subscriber to this service or otherwise receive updates on our products and services, contact us to remove your details from the subscriptions list via our website.

We will assume you consent to management of your personal information in the manner specified in this Privacy Policy (which may change from time to time) and our Privacy Statement until you tell us to the contrary by following the instructions contained in our website or contacting us using our contact details below.

Exchange of personal information with third parties

Personal information we collect from you may be disclosed:

to any entity to which we are required or authorised by or under law to disclose such information (for instance, Federal or State law enforcement agencies and investigative agencies, courts, various other Federal or State government bodies);

to others that you have been informed of at the time any personal information is collected from you;

to our business associates and others for purposes directly related to the purpose for which the personal information is collected;

to airport management and security personnel;

to our professional advisers and other contractors (for example IT consultants and mailing houses); or

We may also obtain personal and other information from some or all of the above to enable us to provide our services or products to you. When we obtain personal and other information from third parties whom we are referred to by you, we will assume and you will ensure that you have made that third party aware of the referral of the persons and purposes involved in the collection, use and disclosure of the relevant personal or other information.

Use and disclosure of personal information by us

If we use or disclose your personal information for a purpose (the secondary purpose) other the main reason for which it was originally collected (the primary purpose), to the extent required by law, we will ensure that:

the secondary purpose is related to the primary purpose of collection (and directly related in the case of sensitive information), and you would reasonably expect that we would use or disclose your information in that way; or

you have consented to the use or disclosure of your personal information for the secondary purpose; or

Site visit information

When you visit our website, we and/or our contractors collect general information about your visit which may include your server address, the date and time of your visit, the pages you accessed, the information you downloaded and the type of Internet browser you used.

We and/or our contractors may use this information in anonymous, aggregated form, for statistical purposes only, to assist us in improving the quality and useability of our website.
